What Is A Product Liability Claim?

It is a legal claim alleging that someone was injured by a defective or dangerous product while using the product as instructed. The defect or flaw is what causes the injury. Product liability claims can be more complex than you might think. One complication is determining the potentially liable parties. This depends on the specifics of the case and the type of product defect. There are three main types of product liability cases:

  • Design defects: The product was designed in an unsafe manner and should not have been sold to the consumer to begin with. An example could be a chainsaw designed without proper guards, leading to serious injuries.
  • Manufacturing defects: The product was designed safely, but subpar manufacturing rendered it dangerous. For instance, perhaps the chainsaw design included a safety guard, but it was poorly attached during manufacturing and fell off during consumer use.
  • Labeling defects: Certain products must have proper labeling, instructions and warnings. For instance, if the label on a medication is incorrect and tells the consumer to take twice the allowable dose, an accidental overdose may occur. The drug may be safe when used correctly, but the consumer was injured because the instructions for use were inaccurate.
